1. Introduction

Welcome to Balkazar ("we", "our", "us", or the "Platform"). Balkazar is based in the Republic of North Macedonia. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.

2. Definitions

  • "User" — any individual who accesses or uses the Platform, whether as a buyer or seller.
  • Listing — an advertisement posted by a User offering an item or service for sale.
  • "Content" — text, images, and any other materials uploaded by Users to the Platform.
  • "Services" — the marketplace functionality provided by Balkazar, including listing, browsing, searching, and messaging.

3. Eligibility

You must be at least 18 years of age to use the Platform.

4. Account Registration

To post listings or contact sellers, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Use of the Platform

Users agree to use the Platform only for lawful purposes. You shall not:

  • Post false, misleading, or fraudulent listings.
  • List stolen goods or parts obtained through illegal means.
  • Harass, threaten, or abuse other Users.
  • Upload viruses, malware, or any harmful code.
  • Circumvent, disable, or interfere with the Platform's security features.
  • Scrape, crawl, or collect data from the Platform without our written consent.
  • Use the Platform for any activity that violates the laws of North Macedonia or any applicable jurisdiction.

6. Listings and Transactions

Balkazar serves as a marketplace platform connecting buyers and sellers. We are not a party to any transaction between Users.

Sellers are solely responsible for the accuracy of their listings, the condition of parts described, and compliance with all applicable consumer protection laws.

7. Pricing

All prices on the Platform are displayed in Euros (EUR), with approximate conversions to local currencies (MKD, RSD, KM, ALL) provided for convenience only.

8. Intellectual Property

All content, design, graphics, logos, and software on the Platform are the property of Balkazar or its licensors and are protected by copyright and intellectual property laws.

9. Content Moderation

We reserve the right, but are not obligated, to review, edit, or remove any Content that violates these Terms or is otherwise objectionable.

10. Limitation of Liability

To the maximum extent permitted by the laws of North Macedonia, Balkazar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

The Platform is provided "as is" and "as available" without any warranties, express or implied.

11. Indemnification

You agree to indemnify, defend, and hold harmless Balkazar and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Platform.

12. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of North Macedonia. Any disputes shall be resolved by the competent courts seated in Skopje.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date.

16. Refund Policy

All purchases made on the Platform, including subscription fees, premium features, and listing boosts, are final and non-refundable. We do not offer refunds for any reason. By making a purchase, you acknowledge and agree that you will not be entitled to a refund.
